Legal And Insurance How To Start


In order to get the new church started, basic Legal and Insurance building blocks should be in place.  From a Legal standpoint:

  • The charter, articles of incorporation, constitution, and by-laws should be drafted.
  • The church should be legally incorporated within the state.
  • Federal tax exempt status should be obtained.
  • In order to begin stewardship activities, appropriate incorporation status and tax exempt status should be in place.

From an Insurance standpoint, basic coverages should be obtained:

  • comprehensive general liability
  • umbrella liability
  • worker's compensation (in some states, e.g. Texas)
  • employee dishonesty
  • directors and officers
  • minister's professional liability (may be provided through the denomination; it is through PCUSA)
  • health (may be provided through the denomination; it is through PCUSA)

Note:  In many cases, insurance coverage can be obtained to protect pastors wherever they are.  Such coverage is in place at Memorial Drive Presbyterian Church in Houston, Texas.  That is, the "designated premises" definition does not limit insurance for the pastor to only when he/she is on church premises.  It is imporant to insure that this type of coverage is in place for new churches that begin by meeting in the pastor's home or in the home of a leader in the new church development.
